Terms and Conditions: C.J.Blacksmiths: 1998-2006 inclusive

C.J.Blacksmiths & The Cast Iron Emporium have been trading via the web since 1998, We have sent our goods to most of the uk and several countries worldwide.

General

  1. The expression "the Supplier" in these conditions shall mean C.J.Blacksmiths” & “The Cast iron Emporium” and any further Partners in his present business (if any) at the date of contract
  2. All quotations are made and all orders are accepted subject to the following conditions. All conditions of the Customer or other conditions or warranties whatsoever are excluded from the Contract or any variation thereof, unless and to the extent expressly accepted by the Supplier in writing.
  3. Quotations shall only be available for acceptance for a maximum period of 30 days from the date thereof and may be withdrawn by the Supplier within such period at any time by written or oral notice.
  4. As a supplier we are not bound to accept your invitation to purchase goods from us, and we are not required to give any reason for declining this purchase whatsoever.
  5. Acceptance of delivery of goods shall constitute acceptance of these Conditions where acceptance has not previously been communicated by the customer to the Supplier.
  6. These Conditions of Sale can only be altered or qualified by a document signed by the Supplier (and not by his servants or agents) setting out the relevant alterations or qualifications in full.
  7. The headings in these Conditions are included for convenience and shall not be considered in construing this Agreement.

Delivery

  1. Normal delivery times for stocked items will be between 10-14 days from receipt of order, if there is to be a delay, and then the customer will advise as to a revisited delivery time. all times will be approximate and offered in good faith
  2. Whilst every effort will be made to accommodate customers delivery date and times, we cannot be held responsible for failure of third party deliveries outside of our control.
  3. Delivery of our goods as described, a delivery service, this is delivered to your door step, and does not include fitting within the house. We are happy to quote for a full delivery service to include installation and commissioning, at extra cost as agreed.
  4. Normal delivery will be on a carrier to a business or home address, this is not a timed or specific timed delivery, From time to time we may decide to deliver your goods using are own or chosen transport.
  5. If a customer requires a specific timed delivery then the carriage price will be advised accordingly and agree, prior to dispatch or charging the customer.
  6. Time for delivery is given as accurately as possible but is not guaranteed. The Customer shall have no right to damages or to cancel the order for failure for any cause to meet any delivery time stated. Date of delivery will be an approximate and be dependent upon prompt receipt of all necessary information, final instructions or approvals being obtained from the Customer. Alterations by the Customer in design specifications or quantities required may result in delay in delivery.
  7. Therefore ‘Time is not of the Essence within our contracts’
  8. Delivery of Made to order items will be as soon as possible, any noticeable delays will be advised.
  9. Where delivery is postponed otherwise than due to default by the Supplier the Customer shall pay all costs and expenses including a reasonable charge for storage and transportation occasioned thereby if required due to excessive time delay.
  10. We are able to offer a personnel delivery service for large or heavy goods, delivery can include fitting , these will be agreed prior to a firm placement or your order.
  11. All goods for delivery outside the EEC are sold ex Uk VAT, The customer will be responsible for obtaining and paying for any import or custom charges for their country concerned including and local taxes and import documentation.
  12. All export goods will be delivered fully insured and packaged via either the supplier’s choice of transport either through our choice of freight forwarder or logistics handler.
  13. All import and local taxes, chargeable upon import of your goods will be paid for by the customer at the point of entry or as required.

Title

Title of the goods shall not pass to the Customer until payment in full has been made under the Contract. Where goods are delivered on an account basis, The Customer shall permit the servants or agents of the Supplier to enter on to the Customer's premises and to repossess the goods at any time prior thereto. The Customer shall only be at liberty to resell the goods purchased from the Supplier prior to the passing of Title on the understanding that if he or it does so resell the goods then he or it will hold on trust for the Supplier so much of the proceeds of sale received by him or it under Contracts which include any of the goods hereby sold either in their original or altered state as are necessary to discharge payment in full to the Supplier.

Cancellation

Non Receipt Of Goods/Damage
Any claim or query regarding non-receipt of goods must be made within one month of receipt of a invoice/order or where a later dispatch date has been advised within one month of the date given.
When you receive your goods, every effort is always made to ensure that the goods arrive in a safe and secure state, please check all goods prior to signing ‘Received in good condition’, as once the goods are signed for, the courier company may well exempt any claim for damaged goods
You’re Right to cancel
if you change your mind about anything you order, you can cancel that order free of charge so long as you do so within seven days of receipt of goods. You do not have to provide any reason for cancellation. We will cancel any such order without charging you, with the exception that we reserve the right to make a charge for carriage costs incurred in delivering your order, all goods must be returned unused and correctly packaged, and free from any defects.
The goods must be fully insured by you to cover the total replacement value, and delivery charges must be met by yourselves, Delivery to be returned via a sign able delivery company. If you wish you may request that the item is changed for another product, and we will be happy to accommodate this where at all possible. In the event of cancellation we guarantee to refund your money within 30 days, via credit card or Cheque payment to include a credit note.
Refund / Replacement

All our mail-order goods are covered under a seven day returns guarantee, meaning that if you are not completely happy with your chosen purchase from us, simply return it to us within seven days for a replacement or refund. No replacement or a refund will be made until the goods have been returned in accordance this undertaking.

Special Instructions
If you give us Special Instructions with regard to your order every effort will be made to adhere to these. If you give us any instructions with regard to leaving goods in a safe place if you are unavailable to sign for receipt we cannot accept any liability for loss or damage for whatever reason.
This guarantee does not affect your Statutory Rights.
Prices

  1. All prices quoted are unless otherwise stated ex works inclusive of Value Added Tax and Carriage  for delivery in the UNITED Kingdom, Goods for delivery outside Great Britain will be advised separately upon application for a quotation. No monies will be charged against any credit card until the shipping charges are confirmed and excepted
  2. We do offer a personnel delivery service for larger goods or goods that may need careful handling, we will agree a firm price for this delivery  before we charge any monies.
  3. In the event of any alteration being required by the Customer in design or specification the Supplier shall be entitled to make an adjustment of the Contract price corresponding to such alteration..

Terms of Payment

Unless otherwise agreed by the Supplier in writing, All  payments shall be made on the date of the invoice relating to the goods prior to dispatch or fitting of any onsite work as agreed.
Payments can be made in Cash, Personnel or Company Chouse, we also accept all major credit cards, and we also accept payments Via Bank Transfer payment direct to our bank account, Account details available on request.
All cheques will be cleared and funds deposited into the suppliers bank account prior to goods being dispatched, clearance of a cheque will take 5 working days, unless special conditions are paid for by the customer.
In the event of default in payment by the Customer in accordance with the agreed terms the Supplier shall be entitled without prejudice to any other right or remedy to suspend all further deliveries and to charge interest on any amount outstanding at a rate of 4% per month or part of a month until full and final settlement.

 

Payment Methods & Security

Our checkout procedure operates on a secure server using 128 bit encryption. A picture of a closed padlock will show near the bottom right corner of your screen. This means that when giving your details, they are fully encrypted (security coded), and remain secure across the Internet and after they reach our order processing centre. Throughout payment and subsequently your credit/debit card details are encrypted to secure all your information from the possibility of unauthorized access or disclosure.
A confirmation that your order has been received safely will be displayed on your screen a few moments later. You will also be e-mailed an order confirmation after further processing.

Fulfillment

If for any reason we are unable to fulfill your order after you have made payment we will refund the payment in full immediately.

Mistakes

Although we like to think it's very unlikely, if we make any mistake to do with your purchase, we will correct the error within 30 days.

Dimensions

The Supplier reserves the right to after or change dimensions of the goods supplied within reasonable limits having regard to the nature of the goods. Dimensions specified by the Supplier are to be treated as approximate only unless the Customer specifically states in writing that exact measurements are required. The incorporation of a reference to any particular type of goods in the trade literature of the Supplier does not constitute a guarantee or representation that the relevant goods or manufactured in whole or in part by the Supplier or that they will be available for order by a Customer at any particular time.

Shortages and defects apparent on inspection

  1.  (I) the Customer must inspect the goods immediately on arrival at his or premises, and check all of the goods before signing to indicte’received goods in good condition’.
  2.  Once signed for’ received in Good Condition’, the supplier cannot be held responsible for any damage claims, this must be claimed against the delivery company.

  3. (ii) a written complaint is made to the Supplier within three working days of receipt of the goods or such shorter period as the carriers conditions (if applicable) require specifying the shortage or defect, and
    (iii) the Supplier is given a reasonable opportunity to inspect the goods and investigate any complaint before any use is made of the goods.
    If a complaint is not made to the Supplier as herein provided then the goods shall be deemed to be in all respects in accordance with the Contract and the Customer shall be bound to the Contract and to pay for the goods accordingly.
  4. Whilst the Supplier endeavors to take all care in packing goods for transit, whether or not the Supplier arranges delivery, the Supplier is in no way responsible for delivery of the goods and is in no way liable for claims for loss or damage in transit which must be made by the Customer against the Carrier in accordance with the Carrier's conditions of transit.
  5. All allegations of total non-delivery of any consignment of the goods must be made by the Customer, in writing to the Carrier and to the Supplier within 7 days the date of the Supplier's advice note or invoice or other notification of dispatch or such shorter time limit as may be specified in any conditions of the Carrier.
  6. Failure by the Customer to comply with the provisions hereof shall render the Customer liable for any temporary or permanent loss of the goods and all additional costs and expenses of the Supplier in relation thereto.

Fulfillment

If for any reason we are unable to fulfill your order after you have made payment we will refund the payment in full immediately.

Guarantee

  1. The Customer shall have no claim or set-off in respect of defects not apparent on inspection at the time of delivery unless (i) a written complaint is sent to the Supplier as soon as reasonably practicable after the defect is noticed and no use is made of the goods thereafter or alteration mode thereto by the Customer before the Supplier is given a reasonable opportunity to inspect the goods. (ii) the complaint is sent within 12 months of the date of delivery by the Supplier or in the case of any items not manufactured by the Supplier within a guarantee period specified by the manufacturer of such item.
  2. The Customer shall not be entitled to any claim or set-off in respect of any repairs or alterations undertaken by the Customer without the prior specific written consent of the Supplier not in respect of any defect arising by reason of fair wear and tear or damage due to misuse
  3. The Supplier agrees in the case of goods supplied by the Supplier being accepted by him as detective or faulty (damage due to fair year and tear or to mistreatment excepted) to deliver replacements or at his option to repay the Customer all sums paid in respect of the defective goods supplied provided that the defect of fault is Ratified to the Supplier in writing in accordance with these Conditions. Delivery of replacements shall include all costs of delivery but shall exclude all consequential loss or removal or rectification work required in connection with the installation of such replacements (if appropriate).

Liability

Save where the Supplier is shown to have failed to exercise reasonable care in the manufacture and supply of goods, the Supplier shall not be liable in any circumstances whatsoever for any loss, damage to property, death or personal injury incurred or suffered by the Customer or any other person as a result of any fault or defect in the goods sold by the Supplier and in no circumstances shall the Supplier be liable for any consequential loss or loss of profits suffered as &-result of any such fault or defect. Further the Supplier's liability whether in respect of one claim or the aggregate of various claims other than claims for death or personal injury due to negligence on the part of the Supplier shall not exceed the purchase price payable by the Customer under the Contract.

Confidentiality

All tools, dies, patterns and other equipment or any drawings, documents, photographs or other information used in the supply or manufacture of any of the Supplier's goods or sent or disclosed to the Customer shall be and remain the property of the Supplier who also reserves any relevant copyrights, unless otherwise expressly agreed in writing. The Customer shall not permit any third party to use such equipment nor to disclose to any third party any measurements, dimensional design or other details or any other information in respect of such equipment drawings or documents at any time.All photographs and descriptions are the sole property of C.J.Blacksiths and any use of the same must be obtained in writing before any use will be allowed.

What Information Do We Collect?
When you order, we need to know your name, e-mail address, delivery address and credit or debit card details. This enables us to process and fulfil your orders and to notify you in the event of any queries. We also request your telephone number, which allows us to contact you urgently if there is a problem with your order. We will communicate with you by e-mail, telephone or letter.
When you request literature we ask for your name, postal address and e-mail address. Your literature will be sent by the conventional postal system.

How Do We Use The Information?
In all cases the information you provide is used for the one time use it was collected for only.
After placing an order with us your details and the details of that transaction are held in our secure filing system for a period of six years and then destroyed.
In the case of catalogue requests your details are destroyed once our literature has been sent to you.
In the case of information requests your details are destroyed once your query has been satisfied.
We have never and will never sell, rent, share, trade or give away any information we hold about you, ie we do not sell customer names, addresses (postal or email) or telephone numbers.
We have never and will never send you unsolicited mail (ie updated catalogues, mail shots etc) either by email or the conventional postal system and we do not 'cold call' by telephone.

Our on line shopping system uses 'cookies' which are small pieces of information that are stored on your computer's hard drive by your browser. Most browsers allow the cookie function to be turned off. If the Customer shall become bankrupt or insolvent or compound with creditors or proceedings are commenced for the liquidation of the Customer (other than for a solvent voluntary winding for the purpose of reconstruction or amalgamation) or if a Receiver or Manager is appointed of all or any part of its assets or undertaking the Supplier shall be entitled to cancel the Contract in whole or in part by notice in writing without prejudice to any right or remedy accrued or accruing to the Supplier.

Force Majeure

The Supplier shall not be under any liability for any delay, loss or damage caused wholly or in part by an Act of God, governmental restriction conditions or control, any laws. rules or regulations of the country of origin of the goods, non-arrival of imported goods, inability to obtain transport of loading facilities or by reason of any act done or not done pursuant to a trade dispute whether such dispute involves his servants or not by reason of any other act, matter or thing beyond his reasonable control.

Notice

Any notice to be served pursuant to these conditions shall be deemed to be well served if sent by registered or recorded delivery post, Fax or E.Mail to the Customer or Supplier at their respective addresses as supplied to that others party and the date of service shall be the day and time such communication would be received in the ordinary course of transmission.
Proper Law

The Contract shall be governed and interpreted exclusively according to the Law of England and shall be subject to the jurisdiction of the English Courts only.
